Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Chaosbyte platform and website (collectively, the "Platform"). The Platform is owned and operated by RALIFY SOLUTIONS INC ("Company", "we", "our", or "us"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.

1. Services

Chaosbyte provides automated security assessment services that help organizations identify vulnerabilities in their web applications, infrastructure, and pipelines. Our Platform includes the following products and services:

• On-demand security assessments
• Continuous security monitoring via CI/CD pipeline integration
• Security training and remediation guidance

2. Account

To use the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating an account
• Maintain and promptly update your account information
• Notify us immediately of any unauthorized use of your account

3. Acceptable Use

You may only use the Platform for lawful purposes and in accordance with these Terms. By using the Platform, you represent and warrant that:

• You have legal authority to conduct security assessments on the target systems you submit
• You are authorized by the system owner to test the targets
• You will not use the Platform to conduct unauthorized security assessments or any other unlawful activity

4. Access and Liability

We access and assess websites solely with the authorization of the account holder who submitted them for review. Any unauthorized access to computer systems is prohibited and may violate applicable law. You may only use the Platform to assess targets you own, operate, or have explicit written permission to test.

5. Restrictions

You agree not to:

• Use the Platform to assess targets that you have not been authorized to test
• Attempting to gain unauthorized access to any part of the Platform, other accounts, or computer systems connected to the Platform
• Use automated tools or scripts to access the Platform other than those explicitly provided by us
• Interfere with or disrupt the integrity or performance of the Platform
• Attempt to reverse engineer, decode, or disassemble any aspect of the Platform
• Use the Platform to deliver spam, phishing, malware or other harmful content

6. Intellectual Property

The Platform and its original content, features, and functionality are and will remain the exclusive property of RALIFY SOLUTIONS INC and its licensors. The Platform is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of RALIFY SOLUTIONS INC.

7. Your Content

When you submit a target for security assessment, you grant us a limited, non-exclusive license to access and scan the target solely for the purpose of providing the requested security assessment services. You retain all rights to the content you submit, including the security assessment results generated for you, except where our Terms of Service requires otherwise or is necessary to provide the requested services.

8. Security Discovery and Outreach

As part of our ongoing efforts to improve web security, we may proactively discover and assess publicly accessible websites operated by third parties, including sites not registered with our Platform. When we identify critical or high-severity vulnerabilities that pose an imminent risk to users or the public, we may reach out to the site operator through professional networking services (such as LinkedIn) to notify them of the issue.

This outreach is conducted with the intention of enabling responsible disclosure. It does not constitute an offer of service, a contractual relationship, or a guarantee of security assessment. We do not assume any ongoing obligation to monitor, remediate, or disclose the vulnerability. Targeted site operators are not bound by these Terms solely as a result of receiving outreach, and they remain responsible for ensuring they have the proper authorizations to conduct any security testing themselves.

We reserve the right to conduct security discovery activities at our sole discretion and may choose not to notify any particular site operator at any time.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your visit to the Platform, to understand our practices.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

SECURITY ASSESSMENTS PROVIDE REASONABLE GROUND BUT DO NOT GUARANTEE THAT ALL VULNERABILITIES WILL BE IDENTIFIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RALIFY SOLUTIONS INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM
• ANY CONTENT OBTAINED THROUGH THE PLATFORM
• UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN
• ANY SECURITY ASSESSMENT RESULTS PROVIDED THROUGH THE PLATFORM

In no event shall RALIFY SOLUTIONS INC's total liability to you for all claims arising from or related to the Platform exceed the amount you have paid RALIFY SOLUTIONS INC for use of the Platform during the twelve (12) month period preceding the date of the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless RALIFY SOLUTIONS INC and its affiliates, officers, agents, and employees from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of any third party
• Your submission of targets for assessment that were not authorized

13. Termination

We reserve the right to terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved in the courts of British Columbia, Canada, or through binding arbitration as permitted by applicable law.
